§ V — The record

The terms, set in the
same type as the promise.

One payment, nothing that renews, no account you are made to create, and a sound app that never once pretends to be a treatment. This sheet says that in the language a lawyer needs.

Who this is between

These terms govern your use of Hush, an Ardenholt program operated by Ruzylo Cloud, LLC ("we", "us"). Using Hush means you agree to them.

The service

Hush is software provided as-is: a private, on-device sleep-sound app. Every sound is synthesized on your device as it plays rather than streamed or unpacked from a recording, which is why it does not loop, needs no network, and ships no audio files. It layers those sounds into mixes and fades them out on a timer you set.

We work to keep it running and useful, but we offer no uptime guarantee and no warranty of fitness for a particular purpose, except where the law requires one.

Not medical advice

Hush plays sound. It is not medical advice, diagnosis, or treatment, it is not a medical device, and it is not a therapy for insomnia, sleep apnea, tinnitus, or any other condition.

Steady sound masks other sound — that is ordinary acoustics, and it is the whole of what we claim. We do not claim a frequency that induces deep sleep, a measured improvement in sleep architecture, or relief from tinnitus. If sleeplessness has lasted weeks, if it travels with snoring, gasping, or daytime sleepiness, or if tinnitus is new or worsening, speak to a clinician; the first-line treatment for chronic insomnia is CBT-I, not an app.

Set the volume so the sound sits under the level of a quiet conversation. Sound played at high volume all night is not deeper sleep, and it is not kind to your hearing.

What you pay, and what that buys

Bought from us: write to [email protected] and the payment comes back. Bought through Apple: Apple handles refunds at reportaproblem.apple.com under its own policy — and if Apple declines inside our thirty days, write to us and we make it right ourselves.

Your mixes and settings are unaffected either way, because they were never anywhere but your device.

Buying on iOS, buying on the web

An in-app purchase on iOS is a one-time unlock, not a subscription: no auto-renewal, no renewal charge, and nothing to switch off afterwards. Apple takes the payment and issues the receipt under its own terms.

A purchase made on the web unlocks the same app: sign in, or paste the key from your receipt. Either route flips the same switch, and buying on one platform never obliges you to buy again on the other.

Your account, if you ever make one

You do not need an account to use Hush. The seven-day trial asks for nothing at all, and neither does the bedtime calculator on this site.

An account exists only to prove what you own. It holds your email address and your licence keys — never your mixes, your timers, or any record of when you were asleep. Your nights never leave your device; your account holds your licences, never your listening.

If you do make one, keep the sign-in link and any key private, and tell us at [email protected] if you believe either has been misused.

What is on your device stays there

Your saved mixes, levels, timer and fade settings live on your device, behind its own lock, and we hold no copy (see the privacy sheet). The app makes no network call while it plays, because there is nothing for it to fetch.

That design makes you responsible for the device and its backups. We cannot recover a set of mixes from a lost, wiped, or inaccessible phone, because there was never a copy at our end to recover it from — which is the same fact that makes the privacy promise on the next sheet worth anything.

Acceptable use

  • Do not present Hush, or anything it plays, as a treatment for a medical condition.
  • Do not redistribute or resell the generated audio as a recorded product.
  • Do not use Hush at a volume, or in a setting, where it would mask a sound someone's safety depends on.
  • Do not break, probe, or reverse-engineer the service, except where the law permits it.

Ending it

You can stop using Hush whenever you like: delete the app and nothing of yours is left behind on our side, because nothing of yours was there. We may suspend website services such as the register if we reasonably believe these terms are being broken, with notice where that is feasible.

Liability

To the maximum extent the law permits, our aggregate liability for any claim arising from your use of Hush is limited to what you paid us in the twelve months before the claim, or $50, whichever is greater. We do not warrant any particular effect on your sleep.

Governing law

These terms are governed by the laws of the State of Delaware, USA, and disputes will be resolved in the state and federal courts located there.

Changes

If we make a material change we will update this sheet and the effective date at its head, and write once to anyone on the register. Continuing to use Hush after a change means you accept it.
